The United Arab Emirates (UAE) government has announced nine categories of foreigners who can obtain a residence permit without securing a job in the country.

The provision, known as the Non-Working Residence Permit, is contained in Article 46 of the UAE’s residence legislation and covers several groups, including students, retirees, remote workers and property owners.

The permit is issued by the Federal Authority for Identity and Citizenship (ICA), subject to approval by the relevant authorities.

Nine Categories Eligible for UAE Residence

According to the UAE’s official legislation portal, foreigners who fall into the following categories may qualify for the permit:

1. Students enrolled in licensed universities, colleges, educational institutions or research institutions in the UAE.
2. Remote workers employed by companies or entities based outside the UAE.
3. Retirees who meet the applicable requirements.
4. Real estate owners who own property within the UAE.
5. Family members of UAE residents, including spouses and children. Parents may also qualify where the main resident holds a Green Residence Permit, subject to the relevant conditions.
6. Family members of UAE citizens who hold foreign passports, including their parents, children and spouses.
7. Foreign spouses and children of GCC citizens who hold foreign passports.
8. Foreign women whose UAE citizen husbands have died or divorced them, provided they have at least one child.
9. Humanitarian cases approved through a resolution issued by the Chairman.

Foreigners Can Reside Without Local Employment

The Non-Working Residence Permit provides a route for eligible foreigners to live in the UAE without being employed by a UAE-based company.

The inclusion of remote workers means people who earn their income from employers or businesses outside the country can potentially maintain residence in the UAE while continuing to work for their overseas employers.

Retirees and property owners are also covered, making the scheme relevant to foreigners who have financial ties to the UAE but do not intend to enter the country’s local employment market.

Family Members Also Covered

The rules extend eligibility beyond individual applicants.

Foreign spouses and children of UAE residents may qualify under the family category, while certain parents can also be sponsored where the main resident holds a Green Residence Permit.

The legislation also provides specific provisions for family members of UAE citizens who hold foreign passports and for foreign spouses and children of GCC nationals.

Other Requirements Still Apply

Being part of one of the nine categories does not automatically guarantee a residence permit.

The UAE legislation contains additional conditions that applicants must satisfy before the ICA can process their applications. These requirements apply alongside the conditions attached to the applicant’s specific category.

The humanitarian provision also gives the authorities discretion to approve cases that may not fall within the other categories, provided a formal resolution is issued by the Chairman.
