In Georgia, an unmarried biological father does not automatically have enforceable custody or visitation rights just because he is the biological father, is on the birth certificate, has a relationship with the child, or pays child support. Georgia Courts’ legitimation page says legitimation is the legal action that lets the father of a child born out of wedlock establish legal rights, and that without legitimation, fathers have no right to custody or visitation while mothers have sole custody. Georgia law says essentially the same thing: only the mother of a child born out of wedlock is entitled to custody unless the father legitimates the child under Georgia’s legitimation statute.
